Common List of Authorities in Patent Law and Trade-Mark Law


The Federal Court of Appeal has published a Common List of Authorities in Patent Law and Trade-Mark Law under the Legislation, Rules and Practice Directions section of its website. This list shall be deemed to be included in the book of authorities prepared by a party pursuant to Rule 70 of the Federal Courts Rules.

Therefore, for proceedings in the Federal Court of Appeal, a party is not required to include these authorities in the party’s book of authorities. However, if a party intends to refer to one of these authorities, the passage upon which they will rely should be included. Furthermore, when citing these authorities within Court documents, parties should provide a citation to the Common List (e.g., CLA Vol.4-I, Part A, Tab 7).

For those authorities not in this Common List, the regular practice should be continued pursuant to the Federal Courts Rules.
